Do wills need to be probated?
In most cases, yes. There are several reasons for this:
- A Will must be verified by a Probate Court as the official record of the Testator's final wishes;
- The Court must recognize the Executor's power, or appoint one if none has been named; and
- The Court must ensure that creditors, family members, and beneficiaries are notified that Probate has commenced.
